Meeting of the European Network of Rail Regulatory Body (ENRRB) has been held

A roundtable discussion on the most recent developments in the Member States was also held within the scope of the meeting as well as discussions on the practice of regulatory bodies and on the organisational changes that took place in the period after the previous meeting, held in January 2020.
 
ZAGREB, 22 January 2021 – On Thursday, 21 January, the European Network of Rail Regulatory Bodies (ENRRB) held its 20th meeting which was attended by the representatives of HAKOM through videoconference. ENRRB is an advisory body of the European Commission in the field of rail services market which examines issues, procedures and practices and aims at harmonisation at the EU level. Within the scope of the meeting a roundtable discussion was held on the most recent developments in the Member States and, among other things, topics were the practice of regulatory bodies and the organisational changes that took place in the period after the former meeting, held in in January 2020.
 
 German and Finnish regulators held presentations on “services connected with rails” which are being provided in ports, the presentations while the European Commission Directorate-General for Mobility and Transport (DG MOVE) presented its views on this subject and encouraged the discussion. The subject of the German regulator's presentation was a court decision regarding the conflicting capacity requirements in the service facility and the respective powers of regulators in this regard. The court proceeding C-453/20, conducted at the request of the Czech regulatory body was presented regarding the interpretation of platform status for loading/unloading of cargo, were also presented.
 
IRG-Rail gave a presentation concerning the interpretation of Articles 32 and 33 of the Directive 2012/34/EU and the term “rate of return”, while the Spanish regulatory authority referred in its presentation to the role of regulator when carrying out the “how much the market can withstand” test in relation to access fees, given the circumstances arising from the pandemic. On the topic of redesign of the process of drafting the international timetable, the presentation was held by IRG-Rail, and DG MOVE presented its opinion on this topic.
