Decision on the obligation of the railway undertaking to act in the event of injury or death of passengers

In the event of a death or injury to a passenger, HŽPP is obliged to pay in advance and no later than 15 days after the identity has been established

ZAGREB, 14 July 2021 -According to  the inspection supervision of the Implementation of the Act on Regulation of the Railway Services Market and the Protection of Passenger Rights in Railway Transport, the Croatian Regulatory Authority for Network Industries has issued a Decision on the Obligation to Act on the Railway Undertaking, (hereinafter: ( HŽPP), in accordance with Articles 13 and 26(1) of the Annex I to Regulation (EC) No 1371/2007 of the European Parliament and of the Council of 23 October 2007 on the rights and obligations of passengers in rail transport (hereinafter: the Regulation).

According to the inspection supervision it has been established that HŽPP has not complied in accordance with the obligation referred to in Articles 13 and 26(1). Annex 1 to the Regulation, that is, it did not pay an advance payment and the HŽPP was ordered to act in accordance with the obligation referred to in Articles 13 and 26(1) Annex 1.to the Regulation, i.e. to pay an advance in case of injury or death of passengers.

In the event of the death or injury of a passenger without delay and in any event no later than 15 days after establishing the identity of the natural person entitled to compensation, HŽPP  shall pay the pre-financing which may be necessary to meet the current economic needs, in proportion to the damage suffered.
