European Commission Launches Targeted Public Consultation on Guidelines for Trusted Flaggers

Stakeholders with relevant experience and expertise are invited to provide feedback on the draft guidelines for the implementation of the trusted flagger provisions under the Digital Services Act.

Zagreb, 1 June 2026 - The European Commission has launched a targeted public consultation on draft guidelines for trusted flaggers under Regulation (EU) 2022/2065, the Digital Services Act (DSA).
The purpose of the consultation is to enable relevant stakeholders to provide feedback, based on their experience and expertise, on the draft guidelines, which are intended to support the consistent application of the rules governing trusted flaggers across the European Union. Trusted flaggers are entities that possess the necessary expertise and competence to detect, identify and report specific types of illegal content online. Under the DSA, online platforms are required to process notices submitted by trusted flaggers as a matter of priority and without undue delay. However, platforms remain responsible for deciding whether to remove the content concerned or otherwise restrict access to it.

Trusted flagger status is granted by the Digital Services Coordinator of the Member State in which the applicant is established. In the Republic of Croatia, the procedure for granting, suspending and revoking trusted flagger status is governed by the Ordinance on the Criteria and Procedure for Granting, Suspending or Revoking Trusted Flagger Status (Official Gazette, No. 49/2026), which entered into force on 21 May 2026.

The European Commission’s guidelines are intended to provide additional support to Digital Services Coordinators and providers of online platforms in applying the criteria for granting trusted flagger status, as well as in dealing with cases involving the potential misuse, suspension or revocation of that status.

The public consultation is open until 26 June 2026.
