European Commission Public Consultation on the Obligation to Report Suspicions of Criminal Offences under Article 18 of the Digital Services Act

Participation open until 19 December 2025

ZAGREB, 19 November 2025 - The European Commission has launched a targeted public consultation on the implementation of the obligation set out in Article 18 of the Digital Services Act (DSA). Under this obligation, providers of hosting services are required to notify the competent authorities immediately whenever they have reason to suspect a criminal offence that poses a threat to the life or safety of an individual or individuals.

The consultation is aimed at:

• Digital Services Coordinators,
• law enforcement and judicial authorities,
• providers of intermediary services,
• experts, researchers, and civil-society organisations

As the Digital Services Coordinator of the Republic of Croatia, HAKOM invites all domestic stakeholders to participate in the consultation and to share this invitation within their professional and organisational networks.
