Trusted Flaggers

A Trusted Flagger is an entity that has been granted the status of trusted flagger by the national coordinator for digital services for a specific type of unlawful content, in accordance with demonstrated expertise.

In the Republic of Croatia, the role of national coordinator for digital services, responsible for granting trusted flagger status, is carried out by HAKOM.

In accordance with the Digital Services Act (DSA), trusted flaggers are responsible for detecting and reporting potentially unlawful content to online platforms.

Article 22 of the DSA obliges providers of online platforms to ensure the priority processing of notifications submitted by trusted flaggers within their area of expertise, and to take decisions on them without undue delay. Platform providers are not required to remove the reported content automatically; however, they must review it as a priority and without unjustified delay.

To acquire trusted flagger status, an applicant must meet the conditions set out in Article 22 of the DSA, including:
  • possessing specialised knowledge and skills necessary for detecting, identifying, and reporting unlawful content;
  • independence from any provider of online platforms; 
  • carrying out reporting activities diligently, accurately, and objectively.

Trusted flagger status may be suspended or revoked in accordance with the provisions of the DSA and applicable national legislation.
