HAKOM launches public call on regulatory issues related to migration from the copper network
The public call is being conducted as part of the preparation of the “Guidelines for HAKOM’s actions in cases of announced copper infrastructure switch-off.” The guidelines concern procedures undertaken by operators when parts of the copper access network are taken out of service or replaced with new infrastructure, in accordance with Article 114 of the Electronic Communications Act.
The purpose of the public call is to collect, in a timely manner, the views of operators and other interested stakeholders and to contribute to ensuring a predictable and transparent regulatory framework for user migration procedures, while safeguarding competition and protecting the rights of end-users.
Within the public call, questions are raised concerning the application of the existing legislative framework, including deadlines for notifying users and operators, the technical and organisational challenges of migration, the availability of replacement services of at least comparable quality, and the protection of end-users during the process of replacing network infrastructure.
The second part of the questions relates to regulatory discussions and initiatives at the level of the European Union concerning the switch-off of copper infrastructure, with the aim of ensuring the timely preparation of the national regulatory framework for future regulatory and market circumstances.
This public call is advisory in nature and does not introduce new regulatory obligations. The guidelines to be developed on the basis of the views received will serve as an interpretative and methodological framework for the application of the applicable statutory provisions, while individual regulatory decisions will be adopted in accordance with procedures prescribed by law.
The public call will remain open until 7 April 2026 at 16:00, and all interested stakeholders may submit their comments and proposals via the HAKOM website at the following link.
