Public consultation on the proposal for an information memorandum for public auction for granting the right to use the RF spectrum

Public consultations were launched on the proposal for an information memorandum for the public auction for granting the rights to use the RF spectrum in the 800 MHz, 900 MHz, 1800 MHz, 2100 MHz, 2600 MHz and 3600 MHz frequency bands and to amend the conditions of individual licences for the use of the RF spectrum.

ZAGREB, 11 August 2022 - The Croatian Regulatory Authority for Network Industries (HAKOM) launched a public consultation on the proposal for an information memorandum for a public auction to grant RF spectrum rights in the 800 MHz, 900 MHz, 1800 MHz, 2100 MHz, 2600 MHz and 3600 MHz frequency bands and to amend the terms and conditions of individual RF spectrum licences.

The modification of the terms and conditions of licences for the use of RF spectrum for public mobile communications networks is proposed in order to harmonise the duration of all RF spectrum licences to 800 MHz, 900 MHz, 1800 MHz, 2100 MHz and 2600 MHz with 18 October 2024, so that all spectrum in the aforementioned frequency bands can be allocated from the same date and thus ensure efficient use of the RF spectrum in the public auction.

HAKOM has decided that a public auction procedure will be carried out for the allocation of rights of use for the aforementioned frequency bands, and for this purpose, an information memorandum containing proposals for conditions and requirements from the Decision on the call for public auction has been drawn up. In drafting the public auction framework, found within the information memorandum, HAKOM also took into account the objectives of the National Plan for Broadband Development in the Republic of Croatia in the period from 2021 to 2027 (OG no. 26/21), which is in line with the National Development Strategy of the Republic of Croatia until 2030. (OG 13/21).

The information Memorandum provides the allocation of national RF spectrum usage rights for 60 MHz (6 2 x 5 MHz frequency blocks) in the 800 MHz, 70 MHz frequency band (7 2 x 5 MHz frequency blocks) in the 900 MHz, 150 MHz frequency band (15 2 x 5 MHz frequency blocks) in the 1800 MHz, 120 MHz frequency band (12 2 x 5 MHz frequency blocks) in the 2100 MHz frequency band and 140 MHz frequency bands (14 2 x 5 MHz frequency blocks) in 2600 MHz. Also, the allocation of rights of use at the regional (county) level for a maximum of 80 MHz in the 3600 MHz frequency band is foreseen, depending on the availability of the RF spectrum in each county. Regarding the regional level licence holders, the 3600 MHz frequency band provides the obligation to start the operation of one base station by 31 December 2024.

The information memorandum shall, inter alia, regulate the obligations to share passive and/or active infrastructure and provide wholesale access to mobile virtual network operators (MVNO). Pursuant to Electronic Communications Act (OG 76/22), HAKOM will issue licenses for use of RF spectrum for a period of 15 years with the possibility of their prolongation for an additional 5 years. It is foreseen that operators may choose to pay the total value of licences once or up to 10 equal annual instalments.
