Draft Regulation on the Criteria and Procedure for Granting, Suspending, or Revoking the Status of a Trusted Flagger in Public Consultation

Public Consultation on the Regulation Open Until 13 April

- The Croatian Regulatory Authority for Network Industries (HAKOM) has published the Draft Regulation on the Criteria and Procedure for Granting, Suspending, or Revoking the Status of Trusted Flaggers for public consultation. The consultation is open from 13 March to 13 April 2026. Trusted flaggers are organisations that, due to their expertise and reliability, are authorised to report illegal content to platforms for priority handling.

The Regulation is adopted pursuant to Article 5(3) of the Act on the Implementation of Regulation (EU) 2022/2065 and ensures the national implementation of Article 22 of the Digital Services Act (DSA), which establishes the framework for trusted flaggers. It sets out the criteria for granting, suspending, and revoking trusted flagger status, as well as HAKOM’s procedures in its capacity as the coordinator for digital services. The Regulation also includes Annex I - a standardised form for submitting applications for trusted flagger status to HAKOM.

Legal entities headquartered in the Republic of Croatia that wish to obtain trusted flagger status may submit their applications electronically, in accordance with the conditions specified in Article 22 of the DSA and the Regulation. Trusted flagger status is granted exclusively to legal entities.
